4 Counter-Notification Process

If you believe that your content was removed or access was disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent. A counter-notification must include the following:

Required Information for Counter-Notification:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled, and its location before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Delaware if outside the United States), and that you will accept service of process from the person who filed the original DMCA notice or their agent

What Happens After You File a Counter-Notification?

Upon receipt of a valid counter-notification, we will:

  1. Forward the counter-notification to the person who filed the original DMCA notice
  2. Inform that person that we may restore the removed content in 10-14 business days
  3. Restore the content within 10-14 business days unless the copyright owner files a court action seeking an injunction

5 Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Inkwellmart has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

Our Policy:

  • We maintain records of all DMCA notices received
  • Accounts with multiple valid infringement claims may be suspended or terminated
  • We may also terminate accounts of users who repeatedly post infringing content after receiving warnings
  • Terminated users may be permanently banned from using our services
